Government contractors, subcontractors, and employers are faced with preparing for and complying with federal, state and local vaccine mandates as part of their businesses. These requirements include the President’s Executive Order 14042 governing COVID Safety Protocols for Federal Contractors; implementation guidance from the Safer Federal Workforce Task Force, incorporated into new Federal Acquisition Regulation (FAR 52.223-99); and new federal facility access restrictions for primes, subcontractors and vendors. Also, new requirements for employers will be part of the soon-to-be issued vaccine mandate from OSHA as part of the Emergency Temporary Standard (ETS) for businesses with more than 100 employees. Tied into these mandates is the need for employers to address employee requests for accommodations on disability and religious grounds, questions about implementation and payment of the cost of vaccines and testing, and related logistical issues.
